Parking Space Use/Pedestrian Plaza

The OBMA does not oversee the Pedestrian Plaza Permits, but we are here to provide guidance if needed.

The Executive Order does not authorize the use of Parking Spaces within the Public Right-of-Way for temporary outdoor business operations. The Temporary Outdoor Business Operation Program will be considered by the City Council tomorrow, July 14th, 2020, and it will provide a streamlined permitting process for Pedestrian Plazas.

A Temporary Outdoor Business permit for Pedestrian Plazas will be required for the use of Parking Spaces within the Public Right of Way, and appropriate safety measures will be reviewed and approved by DSD as expeditiously as possible, along with a Temporary Outdoor Business Encroachment Agreement will need to be included and signed by the business applicant.

If you feel a Pedestrian Plaza is a good option for your business, we encourage you to begin the application process ASAP through the City of San Diego's Development Services Department.

Sidewalk Cafe Update Public Right of Way Permit

We understand the closure of dine-in services temporarily again makes it hard for you to fulfill your financial obligations. As you may have heard, Mayor Kevin Faulconer has signed an Executive Order allowing all restaurants to utilize sidewalk space without a permit.

However, after JULY 14TH, businesses in a Business Improvement District (BID) needs to obtain a Public Right of Way Permit from the OBMA. This will give you the ability to extend your outdoor dining beyond the Executive Order time frame. The OBMA offers a Public Right of Way Permit, which lasts for a full year and is renewable. This permit is 100% administrated by the Ocean Beach MainStreet Association with the City of San Diego.

Once we receive this documentation our office will provide you with a PROW permit.

County of San Diego's recently launched Small Business Stimulus Grant Program

A message from The County of San Diego

Hello OBMA Members

We would like to direct your attention to the County of San Diego's recently launched Small Business Stimulus Grant Program and encourage you to share with your members and networks.

According to the County News Center,

For-profit and nonprofit businesses can apply for grant money if they can show losses and costs are a direct result of the pandemic.

To qualify businesses must have:

  • 100 or fewer employees

  • Headquarters in San Diego County

  • A minimum 1-year operating history as of Feb. 14, 2020

  • Documentation of financial hardship because of COVID-19

Board supervisors had approved using $17 million in CARES Act Coronavirus Relief Fund funds last May to help restaurants and small businesses. Tuesday, the supervisors approved the implementation of the program.

Businesses are urged to apply early. Applications are available now through Oct. 16 – subject to available funding.

County of San Diego - Updated Safe Re-Opening Plan effective July 7, 2020

Most of you are aware of the changes implemented by the County of San Diego beginning tomorrow, July 7th. Below is a message from the County of San Diego, along with a link to the updated Safe Re-Opening plan.

In general, the County will follow the state's Resilience Roadmap.

Because of the recent rise in community spread of COVID-19, the state placed San Diego County on a Monitoring List. After three days on the list, the following businesses need to close unless they can operate outdoors. The closures go into effect in San Diego July 7 and will last at least three weeks.   

  • Dine-in restaurants (outdoor settings, pickup, delivery and drive-thrus still allowed)
  • Wineries and tasting rooms
  • Movie theaters
  • Family entertainment centers (including bowling alleys, arcades)
  • Zoos and museums
  • Cardrooms

The San Diego City Council is scheduled to consider this interim urgency ordinance on July 14, 2020.

Update: Re-opening of Bars, Wineries, Breweries, and Family Entertainment Centers

Hello OBMA Members

We are sure you've heard the great news that more of our merchants can open their doors to the community today, June 12th.

The below message is from the County of San Diego.

Effective June 12, 2020, the County of San Diego Health Officer Order will be amended in accordance with the State of California’s guidance allowing the re-opening of Bars, Wineries and Breweries without food service, and family entertainment centers (bowling alleys, miniature golf, batting cages, arcades). All facilities that have food and beverage service must still follow the guidance in the San Diego Safe Onsite Food and Beverage Plan and complete the San Diego Food Facility, Restaurant, Bar, Winery, Brewery Operating Protocol. Social distancing must be adhered to at all times and customers must wear face coverings when not seated for service. In addition, please note that employees and customers at family entertainment centers must also adhere to social distancing, wear face coverings, and centers must follow the State COVID-19 Guidance for Family Entertainment Centers.

The San Diego Food Facility, Restaurant, Bar, Winery, Brewery Operating Protocol provides guidance on operating in a modified manner with COVID-19 precautions. Prior to re-opening, please review the resources below, modify your operations to meet the COVID‐19 prevention measures and complete the San Diego Food Facility, Restaurant, Bar, Winery, Brewery Operating Protocol. A copy of your Operating Protocol does not need to be submitted to the County; just complete, sign, and post it in your facility. If you have already completed and posted an Operating Protocol, a new protocol does not need to be posted.

Hello OBMA Members let's try this again!!!

We are re-opening the Ocean Beach Farmers Market on June 10th, in a modified fashion, per County Health guidelines. The modified, farm-focused market will look a little bit different, but it will still have the same wonderful community feel. Think of it as a fresh-air grocery store with a focus on fresh fruits, vegetables, nuts, honey, spreads and more along with fresh flowers. There will be a handful of artisan food vendors who will provide to-go food, which the community may take home to enjoy.

A few details:

  • There will be one entrance to the Farmers Market located on the corner of Cable Street and Newport Avenue.
  • There will be three exits located at:
    • Bacon Street and Newport Avenue
    • Either side of the crosswalk on the 4900 block
  • Please note No Parking will be enforced on the 4900 block of Newport Avenue between 2:30pm and 9:30pm on June 10, 2020. No Parking / Tow Away signs have been posted.

Joint Statement by SBA Administrator Jovita Carranza and U.S. Treasury Secretary Steven T. Mnuchin Regarding Enactment of the Paycheck Protection Program Flexibility Act
 
WASHINGTON –SBA Administrator Jovita Carranza and U.S. Treasury Secretary Steven T. Mnuchin issued the following statement today following the enactment of the Paycheck Protection Program (PPP) Flexibility Act:
 
“We want to thank President Trump for his leadership and commend Leader McConnell, Leader Schumer, Speaker Pelosi, and Leader McCarthy for working on a bipartisan basis to pass this legislation for small businesses participating in the Paycheck Protection Program.
 
“We also want to express our gratitude to Chairman Rubio, Ranking Member Cardin, Senator Collins, Congressman Roy, Congressman Phillips, and other members of Congress who have helped to create and guide our implementation of this critical program that has provided over 4.5 million small business loans totaling more than $500 billion to ensure that approximately 50 million hardworking Americans stay connected to their jobs.
 
“This bill will provide businesses with more time and flexibility to keep their employees on the payroll and ensure their continued operations as we safely reopen our country.
 
“We look forward to getting the American people back to work as quickly as possible.”
 
Upcoming Procedures
 
SBA, in consultation with Treasury, will promptly issue rules and guidance, a modified borrower application form, and a modified loan forgiveness application implementing these legislative amendments to the PPP.  These modifications will implement the following important changes:
 
Extend the covered period for loan forgiveness from eight weeks after the date of loan disbursement to 24 weeks after the date of loan disbursement, providing substantially greater flexibility for borrowers to qualify for loan forgiveness.  Borrowers who have already received PPP loans retain the option to use an eight-week covered period.
 
  • Lower the requirements that 75 percent of a borrower’s loan proceeds must be used for payroll costs and that 75 percent of the loan forgiveness amount must have been spent on payroll costs during the 24-week loan forgiveness covered period to 60 percent for each of these requirements. If a borrower uses less than 60 percent of the loan amount for payroll costs during the forgiveness covered period, the borrower will continue to be eligible for partial loan forgiveness, subject to at least 60 percent of the loan forgiveness amount having been used for payroll costs.
 
  • Provide a safe harbor from reductions in loan forgiveness based on reductions in full-time equivalent employees for borrowers that are unable to return to the same level of business activity the business was operating at before February 15, 2020, due to compliance with requirements or guidance issued between March 1, 2020 and December 31, 2020 by the Secretary of Health and Human Services, the Director of the Centers for Disease Control and Prevention, or the Occupational Safety and Health Administration, related to worker or customer safety requirements related to COVID–19.
 
  • Provide a safe harbor from reductions in loan forgiveness based on reductions in full-time equivalent employees, to provide protections for borrowers that are both unable to rehire individuals who were employees of the borrower on February 15, 2020, and unable to hire similarly qualified employees for unfilled positions by December 31, 2020.
 
  • Increase to five years the maturity of PPP loans that are approved by SBA (based on the date SBA assigns a loan number) on or after June 5, 2020.
 
  • Extend the deferral period for borrower payments of principal, interest, and fees on PPP loans to the date that SBA remits the borrower’s loan forgiveness amount to the lender (or, if the borrower does not apply for loan forgiveness, 10 months after the end of the borrower’s loan forgiveness covered period).
 
  • In addition, the new rules will confirm that June 30, 2020, remains the last date on which a PPP loan application can be approved.

A message from the Business Sector Support Team

Recap & Next Steps provided on May 21, 2020

  • At the County Board of Supervisors meeting, held on Tuesday, May 18, 2020, the board approved two measures intended to allow the region to accelerate the reopening of the local economy.
  •  First measure: County will submit plan to Governor’s office and if approved it would move San Diego further into stage two of the of the California Resilience Road Map in coming days
  • Second measure: Pilot Program where a select number of businesses would be permitted to gradually reopen ahead of schedule from Stage Three. This program includes outdoor religious services, research labs, hair and nail salons, fitness facilities, youth and sports clubs, and apartment complex pools.
  • The County is currently working on revising all stages of the Regional Reopening Framework. We have met all federal guidelines in terms of reopening to accelerate to stage 2. Pilot Program request will be submitted for Governor’s consideration
Followed by Questions asked from the community, and answers:
  • Temperature check/Symptom screening process and Confidentiality 
    • The health officer order requires the temperature screenings with the caveat that if you do not have a thermometer available you can do the symptom check. There is no requirement to complete private symptom screenings/temperature screenings. However, employers have discretion to make a plan that works for their business. 
  • Pandemics effect on non-profit vs. for-profit sector
    • Covid-19 is impacting everyone across the board, although non-profits have been uniquely affected by this pandemic. Non-profit funding has been limited, yet our Community Based Organization Sector has recently highlighted organizations that are addressing the gap in resources available for non-profits. 
  • Fitness facility pools
    • At this time, facility pools were not included in the County's request to the Governor. Leadership's initial focus was reopening pools at a limited capacity within the HOA's, condominiums, apartment complexes. Once we monitor the impact of easing the restrictions on pools at 25% capacity, we can review easing restrictions for community pools, recreational pools, and pools located in fitness centers. 
  • When can my business reopen?
    • As soon as the Governor approves San Diego County's acceleration plan, we will begin reopening. The Counties approach to easing restrictions is to review each sector and by groups (i.e., essential businesses, reopened businesses). From those groups defined, sub activities were then differentiated (i.e., retail, manufacturing, restaurant, bars, hair salons night clubs, and even offices), and additional categories were defined  (i.e., congregate living facilities, art, and cultural venues, sporting events, convention centers).
  • Private and Vocational schools
    • According to the Public Health Order, all public or private schools, colleges, and universities shall not hold classes or other school activities where students gather on the school campus. Parents of minor children shall take steps to ensure said children are not participating in activities prohibited by this Order. 
  • Leisure travel and hotel stays 
    • There are currently International holds on travel until June 22nd, and at this time, hotels/lodging for leisure and tourism are not permitted to reopen. 
  • Sanitation of restrooms
    • The requirement for the safe reopening plan is that there is a section of break rooms, bathrooms, and other common areas that should be disinfected frequently on schedule. That schedule is determined by the employer. 
  • Maximum “capacity” requirement
    • In our current framework there is no specified building capacity. However, please be mindful of your businesses fire marshal’s maximum occupancy.
  • Reopened Office settings
    • According to the public health order the current recommendation is that certain businesses could reopen with recommendation for teleworking. There are no prohibitions if it is in conformance with the order and safe reopening plan. 
  • Injury and Illness Prevention Program (IIPP) required for an employee to return to work?
    • While a IIPP  is not required, everything tool utilized to ensure the safety of yourself, employees, and customers is beneficial.
